Fair Mechanics (F.M) Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of Fair Mechanics (“F.M,” “Fair Mechanics,” “we,” “us,” or “our”) and the purchase or performance of automotive services and products arranged through F.M. By using the F.M platform, requesting a service, purchasing a product, accepting a service assignment, or performing services as a vendor, you agree to these Terms.
1. About Fair Mechanics
Fair Mechanics provides a platform and service network intended to connect customers with qualified automotive mechanics, technicians, vendors, and other service providers (“Vendors”).
Depending on the transaction, F.M may facilitate communication, service requests, scheduling, payment, quoting, and other administrative functions between customers and Vendors.
2. Customer Service Requests
Customers may submit requests describing the automotive service they need. A Vendor may review the request and determine whether they are willing and qualified to perform the requested work.
Submitting a service request does not automatically guarantee that a Vendor will accept the job.
3. Quotes and Pricing
Customers may submit an offer or requested price for a service.
A Vendor may accept the customer’s offer or, where permitted by F.M, provide a one-time, non-negotiable quote for the requested service.
Once a quote has been accepted by the customer and Vendor, the parties are expected to honor the agreed price except where additional work is separately authorized.
Additional repairs or services that were not included in the original quote should not be performed without appropriate customer authorization.
4. Vendor Requirements
Vendors performing services through F.M are expected to:
- Possess the knowledge, skills, tools, and equipment reasonably necessary to perform the services they accept.
- Perform services in a professional and workmanlike manner.
- Follow applicable federal, state, and local laws and regulations.
- Follow applicable automotive safety requirements and manufacturer specifications.
- Provide accurate information regarding their qualifications and ability to perform requested services.
- Communicate honestly with customers and F.M.
- Arrive at the agreed service location within the agreed timeframe or promptly notify the customer and F.M of delays.
- Properly document completed work when required by F.M.
- Wear required Fair Mechanics company apparel while performing F.M-assigned services when such apparel is provided or required.
5. Vendor Independent Contractor Relationship
Unless a separate written agreement states otherwise, Vendors performing services through F.M are independent contractors and are not employees of Fair Mechanics.
Nothing in these Terms is intended to create an employer-employee relationship, partnership, joint venture, or agency relationship between F.M and a Vendor.
Vendors are responsible for their own applicable taxes, licenses, permits, tools, equipment, insurance, and business expenses.
6. Vendor Insurance
Vendors are responsible for maintaining any insurance required by law or by their agreement with F.M.
Where a Vendor maintains applicable Errors & Omissions (“E&O”) insurance or other required professional coverage, the Vendor must provide valid proof of coverage when requested.
If a Vendor does not maintain the required E&O insurance, the Vendor may be subject to a different compensation arrangement under the applicable F.M Vendor Agreement, including a 75/25 service split, where applicable.
The specific compensation arrangement applicable to a Vendor will be established by the Vendor Agreement or other written agreement with F.M.
7. F.M Service Fee
Unless otherwise agreed in writing, Fair Mechanics may retain 10% of the service amount for services facilitated through the F.M platform.
The remaining amount will be paid or allocated to the Vendor according to the applicable Vendor Agreement.
Customers may provide tips to Vendors. Tips are separate from the F.M service fee and are intended for the Vendor.
8. Vendor Job Acceptance
Available service requests may be offered to eligible Vendors through the F.M job board or other F.M communication system.
Unless otherwise specified, available jobs may be offered on a first-come, first-served basis.
A Vendor who accepts a job is expected to complete the job or promptly notify F.M if circumstances prevent completion.
Repeatedly accepting jobs and failing to perform them may result in suspension or removal from the F.M Vendor network.
9. Customer Authorization
Vendors may only perform work that has been authorized by the customer.
If additional repairs are discovered during a service, the Vendor should explain the additional work and obtain customer authorization before performing it, unless immediate action is reasonably necessary to prevent imminent damage or a safety hazard.
Unauthorized additional work may not be eligible for payment.
10. Parts and Products
Parts and products used for a service should correspond with the approved service request and quote.
Where the Vendor supplies parts, the Vendor is responsible for accurately representing the parts being supplied and installed.
Where F.M supplies or facilitates the sale of a product, the applicable product return, refund, and warranty terms will apply.
11. Service Quality and Workmanship
Vendors are responsible for the quality of services they perform.
If a customer reports a workmanship issue, F.M may investigate the complaint and request information from the Vendor.
Depending on the circumstances, F.M may require the Vendor to correct an improperly performed service, subject to the applicable Vendor Agreement and warranty terms.
Nothing in these Terms guarantees a refund for completed services.
12. Customer Cancellations and Travel Fees
Customers may cancel a service before the service has been performed, subject to F.M’s Return & Refund Policy.
If a Vendor has already traveled to the customer’s location, a $30 travel fee will apply even if the requested service is subsequently canceled before the repair is performed.
The travel fee compensates for travel expenses and time and is non-refundable once the applicable travel has occurred.
13. Completed Services Are Non-Refundable
Services that have been fully provided are generally non-refundable.
Customers who believe a service was performed incorrectly should contact F.M promptly so the issue can be reviewed.
Any applicable correction, warranty, credit, or other remedy will be determined based on the circumstances and applicable agreement.
14. Products
Products purchased through F.M may be returned for a refund when they are in good repair and otherwise meet the requirements of F.M’s Return & Refund Policy.
Products that have been damaged, misused, altered, improperly installed, or otherwise returned in unacceptable condition may not qualify for a refund.
15. Vendor Conduct
Vendors must treat customers, other Vendors, and F.M personnel professionally.
The following conduct is prohibited:
- Fraudulent or deceptive activity.
- Misrepresentation of qualifications or services.
- Theft or intentional damage to customer property.
- Harassment, threats, or abusive conduct.
- Unauthorized charges.
- Performing unauthorized repairs.
- Falsifying service records.
- Misusing customer information.
- Using F.M customer information for unauthorized purposes.
- Soliciting customers away from F.M in violation of a separate Vendor Agreement.
F.M may suspend or terminate a Vendor’s access to the platform for violations of these Terms or applicable Vendor agreements.
16. Customer Property
Vendors must exercise reasonable care when working on or around customer vehicles and property.
Vendors may be responsible for damage caused by their negligence, misconduct, or failure to follow reasonable safety procedures, subject to applicable law and the terms of any separate Vendor Agreement.
17. Customer Responsibilities
Customers are responsible for:
- Providing accurate vehicle information.
- Describing the requested service as accurately as possible.
- Providing reasonable access to the vehicle and service location.
- Removing personal belongings from the vehicle when appropriate.
- Disclosing known vehicle conditions that may affect the requested service.
- Paying all approved charges.
Customers must not ask Vendors to perform unlawful, unsafe, or unauthorized work.
18. Payments
Customers agree to pay the amount authorized for the service or product, together with any applicable fees disclosed before or during the transaction.
F.M may use third-party payment processors to process transactions.
A Vendor may not impose an additional charge on a customer unless the charge has been properly authorized.
19. Disputes Between Customers and Vendors
F.M may assist in reviewing disputes between customers and Vendors.
F.M’s involvement in a dispute does not necessarily make F.M responsible for the underlying conduct, workmanship, damage, or other issue.
Customers and Vendors remain responsible for their respective obligations under these Terms and any separate agreement applicable to their transaction.
20. Limitation of Responsibility
To the extent permitted by law, F.M is not responsible for the independent acts, omissions, workmanship, negligence, or misconduct of a Vendor acting as an independent contractor.
F.M may take reasonable steps to facilitate communication, investigate complaints, and administer the service network, but such actions do not automatically make F.M the provider of the underlying automotive repair.
Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.
21. Safety
Automotive repair can involve significant risks, including moving vehicles, elevated vehicles, electrical systems, fluids, chemicals, hot components, and mechanical equipment.
Vendors are responsible for using appropriate safety practices, equipment, and procedures when performing services.
Customers should not interfere with or attempt to assist with professional repairs unless requested by the Vendor and doing so is reasonably safe.
22. Compliance With Law
All customers and Vendors must comply with applicable federal, state, and local laws, regulations, licensing requirements, environmental requirements, and safety standards.
F.M may refuse or discontinue services that it reasonably believes would violate applicable law or create an unreasonable safety risk.
23. Platform and Account Use
Users must provide accurate information when creating an account or submitting a service request.
Users are responsible for maintaining the confidentiality of their account information and for activity conducted through their account.
F.M may suspend or terminate accounts involved in fraud, abuse, unlawful conduct, repeated violations of these Terms, or other conduct that threatens the integrity of the F.M service network.
24. Intellectual Property
F.M’s name, logos, branding, website content, graphics, software, and other proprietary materials are owned by or licensed to Fair Mechanics and may not be copied, modified, or used without permission.
Vendors may use F.M branding only as authorized by Fair Mechanics.
25. Changes to These Terms
Fair Mechanics may update these Terms from time to time.
The updated Terms will become effective when posted or otherwise communicated by F.M, unless a different effective date is stated.
Continued use of F.M services after an update constitutes acceptance of the updated Terms to the extent permitted by law.
26. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
27. Entire Agreement
These Terms, together with any applicable Vendor Agreement, service quote, order confirmation, Return & Refund Policy, Privacy Policy, and other written terms provided by F.M, constitute the applicable agreement governing use of F.M services.
Where a separate written Vendor Agreement conflicts with these general Terms, the Vendor Agreement will control with respect to the Vendor’s contractual relationship with F.M.
